RIGHT OF ENTRY AGREEMENT
This Right of Entry Agreement (“Agreement”) is made and entered into by and between the undersigned property owner or authorized representative (“Owner”) and Lummi Nation Connect. The purpose of this Agreement is to allow the Lummi Nation Connect and its authorized contractors to access the property for the installation, maintenance, and operation of fiber optic broadband infrastructure.
SCOPE OF ACCESS
Owner hereby grants Lummi Nation Connect, its employees, agents, and contractors the right to enter upon the property described above for the purpose of installing, inspecting, maintaining, repairing, replacing, and operating fiber optic cable, conduit, and related telecommunications equipment. This right includes temporary use of the property necessary to complete work safely and efficiently.
TERM OF AGREEMENT
This Agreement shall commence upon the date of submission by the Owner and shall remain in effect until installation and restoration are completed, unless extended by mutual written agreement or as necessary to maintain installed equipment.
RESTORATION OF PROPERTY
Lummi Nation Connect agrees to use reasonable care during its work and to restore the property as nearly as practicable to its original condition upon completion of the work.
LIABILITY AND INDEMNIFICATION
Lummi Nation Connect shall be responsible for any damages directly caused by its negligence during installation or maintenance activities. Owner agrees to hold Lummi Nation Connect harmless from any claims arising out of conditions not caused by Lummi Nation Connect or its contractors.
OWNERSHIP OF EQUIPMENT
All equipment installed by Lummi Nation Connect shall remain the property of Lummi Nation Connect. The Owner shall not relocate, modify, or interfere with such equipment.
