Fiber Internet Terms of Service

These Terms of Service explain how Lummi Nation Connect provides fiber internet service, how billing works, and what both you and Lummi Nation Connect are responsible for. This summary is provided for convenience; the full terms below govern your service. 

 

 1.) Agreement

By subscribing to or using Lummi Nation Connect services, you agree to these Terms of Service. 

Lummi Nation Connect may update these Terms from time to time. If you do not agree to a change, you may cancel your service and return all Lummi Nation Connect–owned equipment. 

 2.) Services and Acceptable Use

Lummi Nation Connect provides fiber-based internet access to eligible homes and businesses. 

We make reasonable efforts to activate service by your requested start date. Delays due to construction, permitting, weather, supply shortages, or other circumstances beyond our control are not the responsibility of Lummi Nation Connect. 

Service is provided for use at a single service address and may not be resold, shared, or redistributed. 

Lummi Nation Connect maintains the fiber network and associated equipment, but is not responsible for customer-owned devices, internal wiring, Wi-Fi networks, or third-party equipment. 

3.) Network, Equipment, and Wiring

All fiber lines, network facilities, and equipment installed by Lummi Nation Connect remain the property of Lummi Nation Connect. 

If service is terminated or if Lummi Nation Connect no longer serves your area, we may remove our equipment. 

You are responsible for maintaining any customer-owned wiring or devices not installed by Lummi Nation Connect. 

4.) Billing and Payments

You agree to pay all monthly service charges, installation fees, equipment charges, and other applicable fees. 

Payments are due on the date listed on your bill. Late or unpaid balances may result in the imposition of late fees, suspension of service, or termination. 

You are responsible for all applicable federal, state, tribal, and local taxes and regulatory fees. 

If you move within the service area, relocation fees may apply. 

 5.) Additional Fees

Additional fees may apply for returned payments, missed appointments, non-standard service calls, damaged equipment, or early termination. 

Accounts that remain unpaid may be referred to collections, and collection costs may be added to your balance. 

 6.) Term and Early Termination

Service agreements have an initial one-year term and automatically renew for successive one-year periods unless either party provides written notice at least 30 days before the end of the term. 

If you cancel service early, you may be responsible for early termination fees, equipment removal costs, and any outstanding balances. 

 7.) Billing Disputes

Billing disputes must be reported within 30 days of the billing date. Failure to dispute charges within this timeframe constitutes acceptance of the charges. 

 8.) Suspension and Termination

Lummi Nation Connect may suspend or terminate service for non-payment, violation of these Terms, or misuse of the network. 

 9.) Limitation of Liability

Lummi Nation Connect is not liable for damages caused by service interruptions, outages, or failures unless caused by gross negligence or willful misconduct. 

Our liability is limited to the lesser of one month of service charges or proven damages. 

 10.) No Warranties

Services and equipment are provided “as is” and “as available.” 

We do not guarantee uninterrupted service, specific speeds, or error-free operation. 

You are responsible for securing your devices, networks, and data. 

 11.) Indemnification

You agree to indemnify and hold harmless Lummi Nation Connect from claims arising from your use of the service, including violations of law or acceptable use requirements. 

 12.) Governing Law

These Terms are governed by the laws of the State of Washington and applicable tribal law. 

 13.) Force Majeure

Neither party is liable for failure to perform due to events beyond reasonable control, including natural disasters, severe weather, governmental actions, or network failures outside our control. 

 14.) Arbitration

Disputes must be resolved through binding arbitration under the rules of the American Arbitration Association. Claims must be initiated within one year of the event. 

 15.) Assignment

You may not assign this agreement without written consent. Lummi Nation Connect may assign this agreement as part of a business transition.

16.) SMS / Text Messaging Communications

By providing your mobile phone number to Lummi Nation Connect, you consent to receive SMS or text messages related to your Fiber Internet service, including service notifications, billing reminders, appointment updates, account alerts, and customer support communications. 

Program Name: Lummi Nation Connect 
Program Description: Fiber Internet service notifications and account-related communications. 

Message frequency may vary depending on account activity and service notifications. 

Message and data rates may apply depending on your mobile carrier plan.

By continuing to use our website and Internet services, you acknowledge and agree to our service terms and conditions. Your continued access and use of these services constitutes your acceptance of the full service agreement and your intent to comply with its terms.
